This agreement governs the relationship between you and ArtFeared, the open studio brand operated by Angel Feather Designs LLC. Please read it carefully before commissioning, buying or using this website, because using the site or placing an order means you accept these terms.
These Terms of Service set the ground rules for the whole working relationship between you, the client, and the studio run by the artist ArtFeared. They cover the way commissions are quoted, paid for and delivered, together with the fair use of this website at www.artfeared.lat. Where a painting is sold, the same agreement travels with the invoice so both sides share one clear frame of reference.
ArtFeared and Angel Feather Designs LLC are used here as two names for one business home at 890 E Silver Sage Dr in Sandy, Utah. Whichever label appears on the paper before you, it reaches the same desk and takes its instructions from the same artist and the same ledger. Nothing in this policy tries to slip you a second, hidden company to deal with later.

Angel Feather Designs LLC operates as a computer integrated systems design and custom art service, and it also practices as a working fine art studio producing original works, brand imagery, murals, album artwork, stationery and interior commissions.
All correspondence, invoices and delivery notes refer back to the address above. If you need to confirm the identity of the business you are dealing with, the studio will gladly supply its registration references at your request by email. Legitimacy is the least a client deserves before handing over real money or personal photographs.
Anyone old enough to enter a binding contract under the law of their own country may use this website and place a commission. Because the studio sometimes paints portraits of minors and families, a parent or legal guardian commonly places the order on behalf of younger family members, and in every such case the adult acts as the single responsible client.
If you use this site on behalf of a company, a club, a band or another organization, you promise that you have the authority to bind that organization to these terms. The studio relies on that promise when it begins work, so please be sure of your mandate before writing an order.
This site must not be used for any unlawful purpose, and it must not be used in a way that damages the reputation or the property of the studio or its other clients. Good manners paint easily in both directions, and the ground rule is simply respect.
Every commission begins with a written quote. When you describe an idea, the studio returns a fixed price, a clear description of the work to be created, and a proposed delivery window. That quote acts as an honest offer, and no work begins and no cost is incurred until you accept the quote by returning a signed deposit request or a written confirmation email.
A fixed quote covers the medium, the scale, the level of finish and the number of portrait figures or design rounds agreed at the start. Prices are stated in United States dollars unless the studio writes otherwise. If you ask for a larger canvas, extra figures, a different medium or an extra round of design halfway through, the studio will normally return a separate written addendum with any additional cost before continuing, so a surprise is never bolted onto your bill.
Shipping and any customs, import taxes or duties that a parcel draws at its border are stated clearly on the invoice and are shown again at checkout before any payment. The studio has no appetite for hiding a fee in a corner of the picture where it can only be discovered later.
Most commissions ask for a deposit when the accepted quote is confirmed, commonly half of the agreed price, and the remaining balance falls due before the finished work ships or at collection. The studio will always confirm the deposit amount and the due dates in writing before any money moves.
Payment may be made by the methods shown on the invoice, and card payments are handled by an established payment provider so the studio never holds your full card number. If a balance remains unpaid past its due date, the studio may pause work on the commission until the account is brought up to date. A genuinely late payment does not end a commission by itself, but it does slow the easel, and the studio will write first to agree on a fresh date before any other step is taken.
The written quote forms the scope of the commission. It names the subject, the size, the medium, the finish, the number of included figures or design drafts, and any agreed extras such as framing or a protective coating. The studio will create exactly that work and will not silently swap in something different that it happened to find more interesting.
Major changes to the scope, such as a brand new subject or a jump in canvas size, are treated as a fresh stage of the project. Minor sensible adjustments, such as a slightly warmer background or a tighter crop, are normally absorbed into the same price without paperwork, because reasonable give makes for good art.
This website shows the range of the studio output as examples rather than a promise about a specific individual piece. A photograph or a mockup of a past canvas is illustrative of the studio hand, never a photo of the exact work you will receive, unless the two are clearly the same object.
Commissions often rest on reference photographs that you provide, such as pictures of a family member, a beloved animal, a house or a cherished place. By sharing those images you confirm that you own them or have the right to use them for this commission, and you grant the studio the limited permission to reproduce them solely for the purpose of creating the artwork.
Reference images are kept inside the commission file and are not reused, published as portfolio pieces or given to third parties without your separate written approval. Portraits of children are held to the highest standard of care: only the parent or guardian places the order, and the finished likeness is shared publicly only with that adult clear agreement.
Every reference is expected to be accurate enough for the artist to read a likeness or a scene honestly. Please tell the studio about any detail that should be softened, corrected or imagined, because the artist cannot guess at a feature that the reference does not show and no one has described.
Before the final coats are laid, most commissions pass through a sketch or design approval stage. For portraits and murals this is a pencil or digital study of the composition and the likeness. For brand, cover and stationery work it is a first design round in full color. The number of approval rounds included in the price is written on the quote.
The client reviews the sketch and returns either a clear approval or a concise list of adjustments. Once the layout is approved in writing, the studio proceeds to the finished work, and later requests that would rebuild the whole composition are treated as a new design round or a fresh commission under section 12 below.
Because approval is the point where the two sides agree on the destination, the studio politely asks clients to answer within a sensible window, commonly two weeks, so the project keeps its pace. If no answer arrives after a reminder, the studio may hold the project and pause the delivery clock until the client speaks.
The accepted quote carries the delivery promise: either a single promised date or a clear window of weeks or months. The studio treats that date with respect, because a painting meant for a birthday or a housewarming loses its heart if it drifts.
Where a reference, an approval or a follow up answer is delayed, the delivery window moves by the length of that delay. This is fairness in both directions, since the studio can only finish the work that has been approved in time. If unusual pressure fills the easels, the studio will write well before an established deadline rather than breaking the news late.
Domestic pieces usually travel by tracked courier within the United States, and international pieces by a service that provides a tracking number and insurance for the value of the work. A signature will generally be requested at the receiving door so the parcel does not lie unattended on a step.
When you buy a physical original painting from the studio, you own that physical object, the canvas and its paint, and you may hang it, gift it, or sell it on as a material item as you wish. Copyright in the artwork itself, by which this clause means the right to copy, reproduce and publish the image, remains with the artist and the legal entity Angel Feather Designs LLC unless a separate written assignment says otherwise.
This separate division is the common practice of living art studios across the world. Buying a painting brings the object home but not the right to print thousands of postcards of it, just as buying a novel brings the book but not permission to republish the text. If you do want reproduction rights, for a brand campaign or a promotional use, ask the studio, because a written license can often be granted on fair terms.
For commissions made under section 11 with an express transfer of rights, the studio will state plainly which rights pass to you and which remain with the artist. No right changes hands without a clear line on the paper.
Unless the two sides agree otherwise in writing, the studio grants every buyer a personal license to display a purchased original in the home or office where it is kept and to share reasonable photographs of it, such as a picture posted to own social media. This courteous sharing is welcome and needs no extra fee, because seeing art in a real room is how the studio grows.
Design commissions such as logos, brand marks, album covers and stationery are different, because their entire purpose is reproduction. Those agreements state in writing that the artwork rights transfer to the client, or that the client holds a license to use the artwork for the named purpose, together with the print and screen files that make that use possible.
Where reproduction rights have been granted, they are limited to the project described on the quote unless the studio confirms an extension. Using a logo bought for a shop on an unrelated national advertising campaign, for example, would need a fresh conversation and usually a fresh agreement.
Every human project changes a little along the road, and the studio expects that. Small adjustments that stay inside the approved sketch are made freely as part of the craft. Structural changes, meaning changes that rebuild the composition, change the medium or add a whole new subject, are handled as a new round under a written addendum.
For design work the quote states the rounds included. A revision past that count is offered at a fair hourly or per-round rate shown in advance, never invented at the moment of billing. Clients are free to approve at any stage; there is no pressure to keep ordering rounds simply because the studio offers them.
If a change request is impossible for a technical or material reason, such as a request to erase every shadow from an oil painting already drying, the studio will say so plainly and propose the honest alternative rather than pretend a miracle is coming.
A client may cancel a commission at any point by emailing the studio. If a cancellation arrives before a deposit is taken, nothing is owed. If it arrives after a deposit or a balance has been paid, the studio will refund the amount that has not yet been spent on the work, being careful to keep the account honest for both sides.
For example, once a signed sketch has been drawn and approved, the portion of the price tied to that stage is earned and is not refunded, because the studio bought the time and the materials to deliver it. The studio keeps a simple running note of what has been spent so the returned figure can be explained line by line.
Where copyrighted materials or reproductions have already been delivered, the entitled refund may not include those finished items, in the same way a book that has been read cannot really be handed back for a full price. Customers always receive a written account of how the refund was calculated.
Original paintings are shipped with care and insurance, and the studio expects the joy of the parcel to match the care taken over the canvas. If a work arrives visibly damaged, the client should photograph the box and the work immediately, note the damage on the courier record where that is possible, and email the studio within five days so a claim can move forward quickly.
Because every original canvas is one of a kind, a damaged piece cannot simply be swapped for a twin from a shelf. The studio will usually repair the work, or repaint a replacement at material cost where repair is not possible, working with the courier insurance to make the outcome fair. A digital files order that fails to download correctly is replaced with a fresh version on request.
Custom and made to order pieces that are not damaged are not returned or exchanged simply because the client changed taste after hanging, but the studio will always discuss a commissioned new work as the more graceful way forward rather than leaving a client stranded with a wrong decision.

The site is meant to be read and enjoyed, and a visitor may download or print a reasonable copy of its pages only for personal, non commercial reference use.
You may not scrape the site to rebuild a rival catalog, embed the artwork in a way that breaks source links, or resell any element of the site without written consent. Free viewing is extended with a generous hand, but hot linking an entire gallery page into another storefront is not the same as admiring a single painting.
Nothing in these terms transfers any design or software right to you merely because you can see it. Where a third party supplies an element of the site, their notices and licenses apply to that element and remain in place.

You agree not to use the site to transmit unlawful, harassing, abusive or obscene material, to attempt to gain access to its servers in an unauthorized way, or to place a load on it that would spoil the experience for others.
You also agree not to impersonate another person, to misrepresent your authority to place an order, or to share a password or account token where one is ever issued. The studio keeps the right to refuse service to anyone who abuses these reasonable terms, and that refusal will always be explained rather than delivered as silence.
The studio does not host a public forum or comment wall, so the mischief that often gathers around such places is not part of this quiet gallery. Should a review feature ever appear, the same polite standard of use would apply to the words you leave there.
The names ArtFeared and Angel Feather Designs LLC, the wordmark and any distinctive marks shown on the site are the identifying signs of the studio. You may not register or use a confusingly similar name or mark in a way that suggests affiliation with the studio without permission.
Please tell the studio if you ever see a copy of its artwork appearing on another site without credit, since mistaken or stolen reproductions damage the livelihood of an honest artist. A respectful note to request@artfeared.lat about such a sighting is a real kindness.
This section is not an exhaustive statement of all the studio legal protections, but it names the heart of it: the studio hand, the studio name and the studio body of work belong here and are worth defending.
To the fullest extent the law allows, the studio provides its website and services on an as available basis without express or implied warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose.
This limitation does not touch the honest promises the studio makes about a specific commission, such as the medium, the scale, the finishing coat or the promised delivery date. Those individual promises stand alongside this general clause and are kept as seriously as the invoice that carries them.
Because the studio is a single workshop rather than a giant concern, some jurisdictions do not permit the full scope of this disclaimer. Where a law overrides part of it, the invalid part falls away and the remainder keeps its force.
To the fullest extent the law allows, Angel Feather Designs LLC will not be liable for indirect, incidental, special or consequential damages arising from your use of the website or from any commission, even if the studio was advised of the chance of such loss.
Where liability cannot be excluded by law, it is capped at the amount you paid for the relevant service or commission. This boundary in no way erases the studio responsibility to deliver the work described, to handle your materials with care, or to answer your questions, and it does not remove the cancellation and refund protections set out earlier in these terms.
Nothing in this agreement removes or limits a liability that, under the law of your country, cannot lawfully be removed or limited. The studio would rather over deliver on every promise than hide behind a legal ceiling.
These terms are governed by the laws of the State of Utah in the United States, without regard to its conflict of law rules. Both sides agree that any dispute arising out of this site or a commission will be handled first by a friendly, good faith exchange of emails, because most disagreements between an artist and a client can be settled in a conversation rather than a courtroom.
If a dispute cannot be settled by discussion and the law requires a formal route, the exclusive forum is the state and federal courts located in Utah. By placing an order you agree to that forum, unless the consumer protection law of the country where you live gives you a right that cannot be signed away and overrides this choice.
Nothing here stops the studio from shopping a party whose conduct crosses into fraud or criminal behavior through the appropriate authorities, and does not prevent a resident of a country outside the United States from raising a matter with an authority that governs them at home.
Neither side is responsible for a failure to perform that follows an event beyond reasonable control, such as a natural disaster, a serious illness, a postal interruption, a war or a government order that closes the studio or the delivery lanes. During such an event the studio will write to each live client with the honest picture of delays.
Where a force majeure event stretches on far longer than the two sides expected, the longest relationship prefers a calm plan over a frozen order, so the studio will open a conversation about rescheduling, substituting or fairly concluding the commission in a way that leaves neither party out of pocket for a fault that belongs to nobody.
If delivery and recovery both become permanently impossible, the studio will of course return to the client any deposit or balance that has not been spent, because holding money for a work that can never arrive would not wear well on any wall.
The studio may update these terms from time to time, and the current version is always published on this page with a fresh effective date at the top. Each new order you place after a change is governed by the terms in force on the date that order is accepted.
Changes to these terms never reach backwards to cancel a protection already earned on an older commission. If a revision would make a startling difference to your standing agreement, the studio will reach out by email before continuing with any work so nothing quietly slips.
It is a good habit to glance at the effective date whenever you return to the site. The studio will keep the older version available on request for a reasonable window so the history of the relationship never becomes a mystery.
Questions, corrections, permissions and disputes all arrive at the same open desk.
